L403, the Nebraska E-Verify law, requires every public employer and every public contractor and sub-contractor to use E-Verify. In addition, E-Verify is required for participants in the following tax incentive programs:

  • Nebraska Advantage Act
  • Nebraska Advantage Rural Development Act
  • Nebraska Advantage Microenterprise Tax Credit Act
  • Nebraska Advantage Research and Development Act

In Nebraska, E-Verify use is growing, with more than 5,000 Nebraska employers enrolled. Nebraska employers are on pace to log a record number of queries. Even with E-Verify being voluntary for private employers in Nebraska, nearly 12 percent have enrolled, a 300 percent jump in enrollment since 2009.  Nebraska employers logged 77,000 verifications in 2009, but will check over 200,000 in 2013.
