H. 4400 required that, on and after July 1, 2009, all private employers of one hundred or more employees must either:
1. Register and participate in the E-Verify® program to verify information of all new employees; or
2. Employ only workers who, at the time of employment, possess a valid South Carolina driver's license or identification card issued by the South Carolina Department of Motor Vehicles; are eligible to obtain a South Carolina driver's license or identification card; or possess a valid driver's license or identification card from another state where the license requirements are at least as strict as those in South Carolina.
On July 1, 2010, the law's application expanded to cover all private employers who employ less than one hundred employees.
SB20, effective January 1, 2012, mandates the use of E-Verify®, effectively eliminating the second verification option of the 2009 law. Contractors and sub-contractors holding a public contract are also required to use the system.
Verify I-9's E-Verify® service fully satisfies the requirements of the South Carolina E-Verify® law.
